Japan’s largest bank, Mitsubishi UFJ Financial Group, was already being investigated by United States prosecutors over whether it had failed to detect money laundering and sanctions violations at its branches. On Friday, the bank got a fresh warning that it needed to address the issue, and quickly.
A federal banking regulator, the Office of the Comptroller of the Currency, said it had uncovered serious problems at branches owned by MUFG Bank, the bank’s name in the United States. The regulator said that the bank appeared to have broken anti-money laundering laws on more occasions than previously thought and that it must fix the problems immediately.
The order was the latest in a series of reprimands for the bank, and the first from the agency that became its regulator when MUFG switched from being licensed by New York State to being federally licensed in November 2017.
State regulators and other federal authorities have said for years that MUFG failed to properly monitor who its customers were and where their money came from. The problems were so severe that one former employee likened the bank’s anti-money laundering program to “a dumpster fire.”
Daniel Weidman, an MUFG spokesman, said the bank was “taking immediate corrective action,” and he added that the regulator’s order did not identify specific illegal transactions or sanctions violations.
“We have made substantial investments over the last several years to bring us into full compliance,” Mr. Weidman said. “MUFG Bank is committed to conducting business with the highest levels of integrity, and to continually improving its regulatory compliance.”
Regulators in New York previously fined the bank hundreds of millions of dollars for similar violations. A spokesman for the Department of Financial Services, the state’s banking regulator, had no immediate comment.
The order by the Office of the Comptroller of the Currency on Friday did not come with fines. But an agency spokesman said it was one of several steps the regulator might take.
“The process is often that a consent order is executed and penalties are assessed later,” said the spokesman, Bryan Hubbard.
The order was issued amid a fight between MUFG and the New York regulator over the bank’s decision to leave New York’s jurisdiction and be overseen by the Office of the Comptroller of the Currency instead.
MUFG has said the move was dictated by practical business considerations, but the state accused it of trying to evade oversight by choosing a less-rigorous regulator.
Joseph Otting, the current comptroller of the currency, joined the agency in 2017 after having worked at MUFG in the past. The agency has said Mr. Otting was not involved in granting MUFG a national banking license.
Just after switching regulators, MUFG sued New York in an effort to keep state officials from arguing that they still had a right to monitor the bank. Several months later, federal prosecutors in Manhattan began examining whether MUFG had lied to New York officials about its anti-money laundering programs.
The new order from the currency comptroller’s office suggests the bank should not expect a lighter touch from its new overseers. The agency said it had found things the New York regulator missed.
Douglas Landy, a partner in the banking practice at the law firm Milbank who focuses on regulation and who is not involved in the matter, said that a step like the one the regulator took Friday could be the starting point for negotiations over the size of a potential fine.
“The O.C.C. can dangle in front of them: Fix it fast and your fine will be less,” he said. “They’re not going to explicitly say that, but that will be implied.”B:
